8-year Limited MATTRESS Warranty

 

Thank you for purchasing a mattress manufactured by Hula Bedding Co.  This limited warranty covers mattresses manufactured or distributed by Hula Bedding Co., sold and used only in the United States.  This limited warranty is provided only to the original retail consumer purchaser who purchases the mattress for personal use from an authorized Hula Bedding Co. dealer.

 

What Is Covered and For How Long

HULA BEDDING CO. warrants this product to the original consumer purchaser against defects in materials and workmanship under normal consumer use for a period of eight (8) years from the date of original retail purchase (the “Limited Warranty Period”) as described below.

This warranty covers only normal residential consumer use, and is limited to coverage of the following defects:

Permanent body impressions or indentions of 1 inch or greater visible when no weight is applied to the top of the mattress, measured from the top edge of the mattress and that is not caused from use of an improper or unsupportive foundation or adjustable bed base. The mattress must be continuously used with a matching foundation or a bed frame that can support the combined weight of your body, the mattress and foundation.

What Is Not Covered

This Warranty does not cover:

  • Ordinary wear and tear         
  • Fabric or covering materials              
  • Change in comfort or firmness preference   
  • Decrease in the product’s slow recovery rate (elasticity)
  • Commercial use applications             
  • Damage caused by failure to follow use instructions or during installation
  • Permanent body impressions or indentations of less than 1 inch
  • Soft Spots
  • Slight manufacturing imperfections and flaws (such as rounded corners or a surface that is not perfectly flat)
  • Dampness or mold
  • Allergies or personal sensitivities
  • Odor
  • Damage caused by not unpacking mattress right away upon receipt
  • Foam color change or yellowing
  • Voids in molded products
  • Rips and tears in the foam
  • Burns, stains or spoilage
  • Overall finished product height
  • Consumer abuse
  • Structural damage resulting from storage, moving or transporting
  • Shipping cost related to a warranty service request 

 

Hula Bedding Co. makes no medical or health claims regarding its products.  Allergies, discomfort, or other conditions, are not covered under this Limited Warranty.  Any questions or concerns regarding medical or health conditions should be addressed by a licensed physician.

3-year Limited FOAM MATTRESS TOPPER Warranty

*Note: We currently do not offer a warranty on fabric Mattress Pads

 

Thank you for purchasing a foam mattress topper manufactured by Hula Bedding Co.  This limited warranty covers foam mattress toppers manufactured or distributed by Hula Bedding Co., sold and used only in the United States.  This limited warranty is provided only to the original retail consumer purchaser who purchases the foam mattress topper for personal use from an authorized Hula Bedding Co. retailer.

 

What Is Covered and For How Long

HULA BEDDING CO. warrants this product to the original retail consumer purchaser against defects in materials and workmanship under normal consumer use for a period of three (3) years from the date of original retail purchase (the “Limited Warranty Period”) as described below.

This warranty covers only normal residential consumer use, and is limited to coverage of the following manufacturing defects:

Permanent body impressions or indentations greater than 25% of the original product height below the normal level of the product visible when no weight is applied to the top of the product.

What Is Not Covered

This Warranty does not cover:

  • Ordinary wear and tear         
  • Fabric or covering materials              
  • Change in comfort or firmness preference   
  • Decrease in the product’s slow recovery rate (elasticity)
  • Commercial use applications             
  • Damage caused by failure to follow use instructions or during installation
  • Permanent body impressions or indentations of 25% or less
  • Soft Spots
  • Slight manufacturing imperfections and flaws (such as rounded corners or a surface that is not perfectly flat)
  • Dampness or mold
  • Allergies or personal sensitivities
  • Odor
  • Foam color change or yellowing
  • Voids in molded products
  • Rips and tears in the foam

1-year Limited BOX FOUNDATION Warranty

 

This limited warranty covers box foundations distributed by Hula Bedding Co., sold and used only in the United States.  This limited warranty is provided only to the original retail consumer purchaser who purchases the box foundation for personal use from an authorized Hula Bedding Co. dealer.

 

What Is Covered and For How Long

HULA BEDDING CO. warrants this product to the original consumer purchaser against defects in materials and workmanship under normal residential consumer use for a period of one (1) year from the date of original retail purchase (the “Limited Warranty Period”) as described below. The Limited Warranty thus only applies during the period in which the Product is owned and controlled by the original purchaser of that Product.

In addition, because we cannot handle international shipping and logistics expenses, your box foundation must be in the contiguous United States at the time you wish to take advantage of the Limited Warranty.

This Warranty is limited to material defects resulting from defective materials or workmanship in the Product you have purchased. Hula Bedding Co. will, for 1 year following the date of the original purchase, at Hula Bedding Co.’s option in its sole discretion, repair or replace, or provide a substitute for, any piece or part of the Product found by Hula Bedding Co. to be defective in material or workmanship. The Limited Warranty applies under conditions of normal household use, but does not apply in the case of: negligence, soiling, improper cleaning, misuse, abnormal use, ordinary wear and tear, dings, dents or scratches, accident or commercial use. Color and variations are natural in wood and also are not covered by the Warranty.

Specifically, this Limited Warranty covers the following defects, provided that they arise or appear in circumstances in which you have handled, maintained, and used the Product only for its intended household purpose and have not subjected it to conditions likely to cause deterioration or damage beyond normal wear: Any cosmetic or physical flaw in the material or a manufacturing defect that causes the box foundation or any component part thereof to split, crack, break, or otherwise fail under conditions of normal use and proper handling.

Hula Bedding Co. makes no medical or health claims regarding its products.  Allergies, discomfort, or other conditions, are not covered under this Limited Warranty.  Any questions or concerns regarding medical or health conditions should be addressed by a licensed physician.

WARRANTY PROVISIONS FOR MATTRESSES, FOAM MATTRESS TOPPERS, AND BOX FOUNDATIONS:

Your Responsibilities

If you discover a defect in the product promptly contact Hula Bedding Co. for warranty service.  Save your proof of purchase in the event you have a warranty claim. 

 

How To Get Warranty Service

To obtain Warranty service, email support@hulabed.com . You are responsible for delivery and any shipping costs related to the return of a product purchased under the terms of this warranty and returned for replacement or repair.  However, do not return the product without first obtaining Hula Bedding Co.’s authorization.  Your warranty service claim will be processed within a reasonable period of time.  Response times may vary. 

What We Will Do

If a covered defect occurs and is confirmed upon inspection by Hula Bedding Co. during the Limited Warranty Period, Hula Bedding Co. will replace the product. 

Your proof of purchase is needed to determine the original date of purchase.

If Hula Bedding Co. replaces the product, it may substitute products designated by Hula Bedding Co. to be of comparable quality in the event the product you purchased was discontinued or modified.  Hula Bedding Co. reserves the right to discontinue any product.  If Hula Bedding Co. elects to replace the product and you do not want, decline or accept the replacement product, Hula Bedding Co. shall have no further obligations to you under this warranty. 

Replacement product becomes the property of the consumer purchaser and the replaced product becomes the property of Hula Bedding Co.   Once a replacement product has been provided the consumer, this warranty becomes void and does not extend to the replacement product.

Exclusions and Limitations

HULA BEDDING CO. DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.  IF WE CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE SHALL BE LIMITED TO THE DURATION OF THIS WARRANTY.  NO ONE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS WARRANTY.

 

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, HULA BEDDING CO. SHALL NOT BE LIABLE UNDER ANY THEORY FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DAMAGE TO PERSONAL OR REAL PROPERTY, LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOST GOODWILL, OR FOR THE FAILURE TO PERFORM OUR OBLIGATIONS UNDER THIS WARRANTY.  NO SUCH DAMAGES SHALL BE RECOVERABLE EVEN IF THE REPLACEMENT REMEDIES FAIL THEIR ESSENTIAL PURPOSE.  OUR TOTAL LIABILITY UNDER ANY LEGAL THEORY WILL BE LIMITED TO THE ORIGINAL RETAIL PURCHASE PRICE PAID BY THE CONSUMER FOR THE PRODUCT EXCLUDING TAXES AND SHIPPING COSTS.

 

This Limited Warranty applies only to products (i) manufactured and/or distributed by Hula Bedding Co. that can be identified as such and (ii) purchased in the contiguous United States of America (including the District of Columbia).  Excludes Alaska, Hawaii, and U. S. Territories.

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you.  This Limited Warranty gives you specific legal rights and you may also have other rights which vary from state to state.

1-year Limited ADJUSTABLE BED FRAME Warranty 

This limited warranty covers adjustable bed frames distributed by Hula Bedding Co., sold and used only in the United States. This limited warranty is provided only to the original retail consumer purchaser who purchases the adjustable bed frame for personal use from an authorized Hula Bedding Co. dealer.

 

What Is Covered and For How Long

 

HULA BEDDING CO. warrants this product to the original consumer purchaser against defects in materials and workmanship under normal residential consumer use for a period of ONE (1) YEAR from the date of original retail purchase (the “Limited Warranty Period”) as described below. The Limited Warranty thus only applies during the period in which the Product is owned and controlled by the original purchaser of that Product.

 

In addition, because we cannot handle international shipping and logistics expenses, your adjustable bed frame must be in the contiguous United States at the time you wish to take advantage of the Limited Warranty.

 

This Warranty is limited to defects resulting from defective materials or workmanship in the Product you have purchased. Hula Bedding Co. will, for one (1) year following the date of the original purchase, at Hula Bedding Co.’s option in its sole discretion, repair or replace, or provide a substitute for, any defective replaceable parts on the adjustable bed frame found by Hula Bedding Co. to be defective in material or workmanship.  The Limited Warranty applies under conditions of normal household use, but does not apply in the case of: negligence, soiling, improper cleaning, misuse, abnormal use, ordinary wear and tear, dings, dents or scratches, accident or non-residential use.  Specifically, this Limited Warranty covers defects, provided that they arise or appear in circumstances in which you have handled, maintained, and used the Product only for its intended household purpose and have not subjected it to conditions likely to cause deterioration or damage beyond normal wear.

 

What Is Not Covered 

This warranty does not apply to:

  • Freight or transit damage
  • Wear & tear caused by normal daily use
  • Consumer damage or abuse
  • Staining or soiling
  • Dings, dents, scratches, or tears
  • Fabric or covering materials
  • Non-residential uses
  • Damage caused by failure to follow instructions during or after installation
  • Structural damage resulting from storage, moving or transporting
  • Failure to follow recommended weight restriction (see Owner’s Manual)
  • Alterations to the bed frame, parts or electrical components
  • Physical or electrical abuse or misuse, or otherwise operated in any manner inconsistent with the operation and maintenance procedures outlined in the Owner’s Manual and this warranty
  • Shipping cost related to a warranty service request

 

Additional Warranty Information

 

This adjustable bed frame is intended for normal, indoor, residential use only. The warranty does not apply to products used for rental, business, commercial, institutional, or other non-residential uses. This warranty is voided by evidence of excessive soiling, improper cleaning, treatment, abuse or abnormal use.

 

The warranty is for repair, replacement or substitution only, in Hula Bedding Co.’s sole discretion. Refunds and returns are not available.

 

CAUTIONS AND DISCLAIMERS

SAFETY HAZARD—MOVING PARTS:

This bedframe has moving, motorized parts, that can be a safety hazard to small children, pets, and those with limited mobility. Do not allow any persons or pets under the bed while in use. Keep clear of the bedframe when in motion. Children and/or disabled individuals should not operate this adjustable bed without adult supervision. 

HOSPITAL OR DISABLED USE DISCLAIMER:

Adjustable beds are designed and engineered for a lifestyle of in-home comfort and are NOT intended for hospital use or for a person on prolonged bed rest. Adjustable beds are not equipped with bars to help patients get safely in and out of bed and are NOT intended to be used around tent type oxygen therapy or explosive gases.

Warranty Service

 

Repairs to or replacement of an adjustable bed or its components under the terms of this limited warranty will apply to the original warranty period and will not serve to extend such period. The warranty is limited to manufacturing defects on replaceable parts only. The decision to repair or to replace defective parts under this warranty shall be made, or cause to be made, by Hula Bedding Co. at its option and in its sole discretion. Repair or replacement shall be the sole remedy of the purchaser. There shall be no liability on the part of Hula Bedding Co. for any special, indirect, incidental, or consequential damages or for any other damage, claim, or loss not expressly covered by the terms of this warranty. This limited warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs of expense. 

 

How to Get Warranty Service
